TERMS AND CONDITIONS OF USE FOR USERS
The services covered by these General Terms and Conditions of Use are provided by Pausetiv Srl, an Italian company registered with the Companies Register under tax code and VAT no. IT13504440960, with its registered office in Milan (20123 MI), Corso Genova 27 (hereinafter, “PAUSETIV”or the “Company”).
This preamble forms an integral and substantive part of the General Terms and Conditions for use of the PAUSETIV website set out below.
1.1 These General Terms and Conditions of Use for Users (the “Terms”) govern use of the PAUSETIV website (the “Site”), owned by Pausetiv S.r.l., through which Pausetiv offers innovative services supporting women’s health, with a specific focus on the personalised management of menopause and related stages.
The Platform enables users to:
· access informative content and educational resources on menopause;
· complete questionnaires aimed at collecting health and wellness data;
· upload documentation useful for assessing their state of health;
· receive personalised treatment plans drawn up by a medical team and specialised professionals;
· book and conduct tele-medicine consultations with doctors and other specialists (gynaecologists, endocrinologists, nutritionists, psychologists and others);
· monitor their symptoms over timevia integrated digital tools.
Through these services, Pausetiv seeks to facilitate access to a comprehensive, multidisciplinary, person-centred pathway aimed at improving the quality of life of menopausal women, promoting awareness, prevention and easier access to personalised care.
All health-related activities are managed by qualified healthcare professionals within a system that facilitates the meeting of patients and specialists, allowing users to identify and select professionals and to manage bookings and payments.
1.2 Access to and use of the Site imply full acceptance of these Terms. Please read these Terms carefully before using the Site. Acceptance of the appointment is finalised exclusively upon payment for the service via the Stripe platform.
2.1 In this document, the following terms shall have the meanings set out below:
· “Site”: the PAUSETIV website, accessible at https://www.pausetiv.com/it, managed by PAUSETIV.
· “Services”: all services offered by the Professionals through the Site.
· “Professional”: a specialist doctor, nutritionist, psychotherapist, dietician, physiotherapist registered with the relevant Professional Register, personal trainer or other professional specialising in menopause.
· “User”: any natural person who accesses the Site to use the digital platform’s Services: educational content, digital symptom-monitoring tools, wellness support and access to the services of specialised Professionals.
3.1 Through the Site, PAUSETIV offers access to a qualified network of healthcare Professionals. Registration by Users is required to access the Services and information on the Professionals.
3.2 The Site’s role is to facilitate the meeting between Users and Professionals, by selecting menopause-specialist professionals who will be accessible to users through the digital platform, with its appointment-booking and visit-management functions, and its collection of health data relevant to professionals for diagnosis and treatment-prescription purposes.
3.3 The visit-booking service is a service provided by PAUSETIV to the Professional: PAUSETIV provides dedicated access to the Cal.com platform, through which the Professional organises their appointment diary, becomes available and interacts with Users. To this end, theUser is redirected to the PAUSETIV booking platform at the URL“app.pausetiv.com/patient/booking”. The contractual relationship is established between the User and the Professional, who is solely responsible for their professional activity, as further specified in section 12 of these Terms, and with PAUSETIV for access to educational content and digital symptom and wellness-monitoring tools.
4.1 The Site allows the User to consult Professionals’ profiles, access information on available Services, book visits and upload medical reports and documentation through PAUSETIV in the appropriate section of their personal area.
4.2 The Site offers Users informational support and facilitation of access to personalised menopause-management treatment plans via a qualified network of Professionals specialised in various areas of women’s menopausal health and wellness, including, but not limited to:
· Women’s-health Professionals specialised in menopause management (doctors, gynaecologists, endocrinologists);
· Nutrition Professionals(dieticians, nutritionists);
· Physical-rehabilitationProfessionals (physiotherapists);
· Personal trainers;
· Other health specialists.
4.3 Services are provided online, via videoconference using the Cal.com platform.
4.4 The User may express preferences for specific therapeutic approaches during the tele-visit with the Professional. During the tele-visit, the User may also receive detailed information on the different therapeutic methods and request clarification on the approach best suited to their needs. Such clarification may also be requested subsequently by contacting the Professional through Pausetiv’s support channels.
4.5 Within their professional autonomy, the Professional assesses the suitability of the approach for the User’s needs, provides clear explanations of the proposed method and may suggest alternative approaches if deemed more effective for the specific case.
5.1 By accepting these Terms, the User declares and warrants that they are of legal age. If Services are booked on behalf of third parties, the User warrants that they are authorised to make the booking and to enter the relevant data.
5.2 During the booking process, the User must provide truthful and accurate information about their identity and health conditions. It is not permitted to enter false or fictitious data, nor to use data of third parties without specific authorisation.
5.3 PAUSETIV relies on the truthfulness of the information provided by the User and reserves the right to verify such information through: confirmation of identity via e-mail verification; review by the Professional of the information entered by the User when completing questionnaires and uploading documents on the platform. If untruthful information is detected, PAUSETIV may deny or suspend access to the Site.
5.4 To allow correct issuance of tax documents, the User undertakes to provide accurate and complete tax data, assuming responsibility for any errors or inaccuracies in the information provided.
6.1 The User selects the Professional from those available on the Platform by consulting the relevant profile sheet and considering their personal preferences. The choice is made independently by theUser, without any discretionary intervention by PAUSETIV regarding the content of healthcare services. In the event of changes, the User may contact PAUSETIV’s support channels to modify the choice of Professional.
6.2 The User acknowledges and accepts that PAUSETIV assumes no responsibility for the quality, adequacy, effectiveness or outcome of healthcare services provided by the Professional, nor can it be held liable for any direct or indirect damages arising from the Professional’s activity. It is understood that any dispute, claim or complaint relating to the healthcare activity must be addressed exclusively to the Professional who performed the service.
7.1 The registration and booking process comprises the following steps:
a) The User, by accessing the URL (app.pausetiv.com/patient/initial-questionnaire), completes an onboarding questionnaire in which they are invited to provide personal information about their state of well-being and lifestyle;
b) After completing the questionnaire, the User may request more information about PAUSETIV’s services or book an online visit with a Professional;
c) If requesting more information, the User is invited to tick a box confirming that they have read the privacy notice and to enter their e-mail address to be contacted by a PAUSETIV representative and receive further information on the available services;
d) To book a visit with a Professional, the User registers on the platform and is asked to accept these Terms and Conditions as well as to confirm that they have read the Privacy Notice and, where necessary, to give consent to personal data processing, entering their identification and authentication data;
e) Once registration is complete, the User receives an e-mail inviting them to confirm the e-mail address provided, to ensure their identity;
f) After e-mail verification, the User is redirected to the PAUSETIV screen where they can book a visit with a Professional or request more information;
g) If requesting more information, the next screen informs the User that Pausetiv will contact them shortly;
h) Selecting the visit-booking option, the User is invited to complete a questionnaire aimed at understanding the User’s state of health and well-being;
i) At the end of the questionnaire, the User may book the visit by first selecting a Professional from the options provided by PAUSETIV;
l) Subsequently, at the e-mail address provided during registration, the User receives an e-mail from the PAUSETIV team containing the link to make payment and book the medical visit;
l) Accessing the visit booking, the system presents the User with a booking interface structured on three levels: (i) an interactive monthly calendar for selecting the date; (ii) highlighting of days actually available for booking within the selected month; (iii) for each selected date, detailed display of the time slots available for the requested service;
m) Once the preferred date and time have been identified, the User confirms their selection via the “confirm” button located at the top-right corner of the interface;
o) If the User has booked a visit, the screen directs the User to the payment link, which redirects to the Stripe platform where the User can enter their credit-card details. Once payment is complete, a confirmation screen appears, anticipating the sending of the instructions for connecting to the online visit;
p) After payment, the User receives an e-mail containing:
– the request for informed consent to tele-medicine with a clickable link to the document. The e-mail specifies that signing the consent is necessary to initiate and continue treatment. Consent may be withdrawn by contacting theProfessional through PAUSETIV’s channels (info@pausetiv.com) to communicate the decision to withdraw consent;
– the payment confirmation showing the appointment details;
– the link to access the video call;
q) If the appointment needs to be cancelled, the refund process is managed according to the procedures set out in section 9 “Cancellation policies”;
r) The User is responsible for keeping and using their payment credentials. Communicating the credentials to third parties is entirely at the User’s responsibility, and the User will be held liable for all transactions completed by third parties to whom they have granted use of their credentials;
s) This responsibility remains until the User expressly notifies Stripe of the revocation of authorisation for transactions completed by that specific person.To be considered valid, such revocation must be communicated to Stripe in advance;
t) Users are therefore advised not to share their payment credentials and, if sharing is necessary, to carefully monitor their use, immediately revoking authorisation if there are doubts about misuse.
8.1 The diagnostic and prescription process is structured as follows:
a) At the end of the visit, the Professional may prescribe any diagnostic tests in their reserved area; the User receives these via e-mail;
b) The User uploads the test results in the appropriate section of their personal area on the Site;
c) The User then receives an e-mail inviting them to access their personal areato view the diagnostic report, together with any prescriptions and recommendations provided by the Professional;
d) If deemed appropriate, the User may schedule a follow-up appointment by contacting PAUSETIV through the support channels.
9.1 Any change to the appointment requires at least 24 hours’ notice prior to the scheduled time. Changes are subject to theProfessional’s availability and may entail variations in the Service price.
9.2 Cancellations and related refunds are managed exclusively through PAUSETIV support channels by contacting prenotazione@pausetiv.com. In the event of cancellation more than 24 hours in advance, the User is entitled to a full refund or to modify the appointment. No refund is provided for cancellations made with less than 24 hours’ notice.
9.3 If the Professional is unable to provide the service, the User is entitled to a full refund regardless of notice.
10.1 Payment processing
10.1.1 All payments are processed through the Stripe system. Every transaction is subject to the platform’s security policies, thereby ensuring maximum security in payment operations.
10.2 Technical support
10.2.1 For any issue concerning appointments (bookings, changes, cancellations, rescheduling), Users may contact info@pausetiv.com.
11.1 Personal-data processing
11.1.1 This website operates solely as an informational showcase and point of access to the services provided by the Professionals.
11.2 Privacy notices
11.2.1 For details on personal-data processing, please refer to the specific notices provided by each Data Controller.
11.3 Roles and responsibilities in processing
11.3.1 In accordance with the General Data Protection Regulation (GDPR), it is specified that:
a) PAUSETIV acts as data controller solely for identification/contact data and browsing data on its own site;
b) The Professional selected by the User is an independent data controller forhealth data, being solely responsible for the professional service;
c) PAUSETIV acts as data processor on behalf of the Professional, who remains the data controller of their patients’ data, for the purpose of delivering the healthcare service;
d) Stripe acts as an independent controller for payment-data processing, according to its own policies.
11.4 Booking and access to notices
11.4.1 During the booking process, the User receives the notice of the selected Professional, acknowledgement of which is necessary to finalise the booking. The User may also consult at any time PAUSETIV’s privacy notice available on the Site, as well as the notices of any third parties involved.
12.1 PAUSETIV assumes no responsibility for the Professionals’ qualifications or for the quality of the healthcare service provided.
12.2 PAUSETIV assumes no responsibility for the specific execution of professional services.
12.3 The User expressly acknowledges that the therapeutic relationship is established directly with the Professional and that PAUSETIV does not intervene in the professional relationship. Services are provided under the sole responsibility of the Professional.
12.4 PAUSETIV’s maximum liability to the User, for any cause, shall in no case exceed the total amount paid by the User in the 12 months preceding the event that gave rise to liability. In no event shall PAUSETIV be liable for indirect or consequential damages, loss of profit, loss of business opportunities, or damage to image or reputation.
12.5 The Site’s services are provided “as is” and“as available”, without any warranties of any kind, express or implied. In particular, PAUSETIV provides no warranty regarding the continuous or uninterrupted operation of the Site, the absence of errors or defects in the software, compatibility with all devices or browsers, user satisfaction, or the achievement of specific results.
12.6 As software provider, PAUSETIV declines all liability for any regulatory infringements resulting from improper use of theSite by the Professional. Collection of informed consents, processing of Users’ personal data and their processing outside the Site, as well as the clinical risk associated with the services provided, are the exclusive responsibility of the Professional. PAUSETIV also declines any liability for any fraudulent or unlawful use by third parties of credit cards, cheques and other means of payment.
13.1 PAUSETIV owns or holds the relevant licences for the exploitation rights to the Site’s intellectual property and any related content. The Site, its architecture, source code, underlying algorithm, graphic interfaces, as well as contents and figurative and word marks, are the exclusive property of PAUSETIV.
13.2 Access to and use of the Site do not entail any transfer of rights to the User. Users are not authorised to perform reverse engineering, decompile, disassemble or modify the Site’s software, nor to copy, modify or alter contents or use robots, spiders or other automatic means to access the Site.
13.3 If the User sends or publishes information on the Site, they warrant that they are entitled to do so freely, without infringing intellectual or industrial property rights, trade secrets or other third-party rights, and without providing confidential information that could cause harm.
13.4 All trademarks, trade names and distinctive signs on the Site are owned by PAUSETIV or by third parties that have granted the relevant licence. Any form of distribution, modification or public communication not expressly authorised is prohibited.
14.1 PAUSETIV reserves the right to amend theseTerms with 30 days’ notice, to suspend or terminate the service for just cause, and to remove Professionals from the network if they fail to meet required standards. The User may discontinue use of the Site at any time.
15.1 These Terms are governed by Italian law. Formatters not expressly covered herein, reference is made, where applicable, to the provisions of the Italian Consumer Code (Legislative Decree 206/2005).
15.2 For out-of-court resolution of disputes relating to the application, execution, interpretation and breach of these Terms, the User may resort to Alternative Dispute Resolution (ADR) bodies via the European Commission’s Online Dispute Resolution (ODR) platform, accessible at: http://ec.europa.eu/consumers/odr/.
15.3 A User resident in an EU Member State other than Italy may bring proceedings before the courts of the Member State in which they reside or are domiciled.
16.1 Pursuant to Articles 1341 and 1342 of the Italian Civil Code, the following clauses are specifically approved: 0, 3.2,3.3, 3.4, 4.4, 4.5, 5.1, 5.2, 5.3, 5.4, 6.2, 7.1 r) s), 9.1, 9.2, 9.3, 10.1.1,11.1.1, 11.2.1, 11.3, 11.4.1, 12.1, 12.2, 12.3, 12.4, 12.5, 12.6, 13.1, 13.2,13.3, 13.4, 14.1, 15.1, 15.2, 15.3, 16.1.
